Title: Intellectual Property

In an effort to foster scholarly and creative activities, the president shall establish procedures to protect the intellectual property rights of the college and its employees.

In such cases where the efforts of employee(s) in the normal conduct of their duties and wholly within their contractual obligations to the college produce intellectual properties which are determined to have commercial value, such properties shall be the property of the college. 

In such cases where the intellectual properties were produced, at least in part, within a contractual agreement with the college, any proceeds from the sale of the properties shall be shared between the college and the employee(s) in a manner that is mutually agreeable to the college and the employee(s).

In such cases where the intellectual properties were produced by employee(s) entirely on their own time and at their own expense they shall be the exclusive properties of the employee(s).

Cases not adequately covered by this policy will be determined by specific contractual agreement among all parties involved.
